01Acceptance of these terms

These Terms & Conditions ("Terms") are a binding agreement between you and Gaskivo, a brand of The Nelson M Group LLC ("Gaskivo," "we," "us"). They govern your use of gaskivo.com and related services, among them email and text-message programs (the "Services"). By using the Services or submitting a form, you agree to these Terms, our Privacy Policy, and, if you opt in to texts, our SMS Terms. If these Terms are not acceptable to you, do not use the Services.

02What Gaskivo is, and is not

Gaskivo is an information service. We publish general, plain-language details about how insurance works, how to read a policy, and what tends to affect insurance costs, and let visitors opt in to related updates. We do not sell insurance, give quotes, rates, or price estimates, match people with agents or insurers, or refer people to providers, and we will not share your details with agents, insurers, or any other business partners.

• Decisions about your insurance are yours. Reading our content does not obligate you to do anything.
• Your own insurer or agent, not Gaskivo, explains the terms, limits, exclusions, and costs of any policy, and is responsible for your coverage.
• Costs, coverage, and savings vary by person, plan, and location. We do not guarantee that you will save any amount, qualify for any coverage or discount, or get any particular result.

03Eligibility

You must be at least 18 years old, located in the United States, and able to form a binding contract to use the Services. You may only submit data about yourself, or about another person who has authorized you to do so.

04Your information and accuracy

Please keep the details you give us correct and current. Enter a mobile number only if you own it or are authorized to use it. If your number changes or is reassigned, please reply STOP from the old number or contact us so that we do not message someone else.

05Communications and text-message consent

If you choose to opt in, you consent to being contacted by email and, if you tick the boxes that apply, by automated text messages as set out in the SMS Terms. Consent to texts is optional, is not a condition of purchase or of using the Services, and may be withdrawn at any time by replying STOP. Message frequency varies. Message and data rates may apply. 06Text messaging: rates, frequency, STOP and HELP

Message and data rates may apply. Message frequency may vary (up to about 8 messages a month, depending on the topics you choose). Text START to join, or opt in with the form on our Get Started or text updates page. Consent is not a condition of purchase or of using the Services.

• STOP: Reply STOP to any message to opt out (STOPALL, UNSUBSCRIBE, CANCEL, END and QUIT also work). You will get one confirmation text and then no more messages.
• HELP: Reply HELP to any message for help, or contact us by email at [email protected] or by phone at 888-924-0798.

Mobile information and opt-in data are not sold or shared with third parties or affiliates for marketing or promotional purposes. See the Privacy Policy and SMS Terms.

07Acceptable use

Prohibited conduct includes: (a) false, misleading, or third-party information; (b) unlawful, fraudulent, or abusive use; (c) interference with the Services or unauthorized access attempts; (d) bots or automated form submission; (e) copying, scraping, or reselling content without permission; and (f) impersonation. We can suspend or end your access if you engage in any of it.

08Third-party organizations and links

Organizations, programs, and products mentioned on or linked from the Services (say state insurance departments, consumer groups, or insurers) are run independently of us. Mentioning one is not an endorsement of any product, plan, or provider, and we are not responsible for third-party conduct, content, or results. Your relationship with an insurer or agent is between you and them.

09Intellectual property

The Services, including the Gaskivo name, logo, text, graphics, and design, are our property or that of our licensors, and intellectual property laws protect them. The license we grant you to view and use the Services is limited, revocable, non-exclusive, non-transferable, and for personal, non-commercial use. The Site's photographs are used under free-use licenses.

10Disclaimers

The services and all content are given "as is" and "as available" without warranties of any kind, whether express or implied, among them implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the services will be uninterrupted, error-free, or secure, or that any message will be delivered or delivered on time.

Gaskivo does not supply insurance, legal, or financial advice, and makes no representation about any policy, coverage, price, savings amount, or claim outcome.

11Limitation of liability

To the fullest extent permitted by law, Gaskivo and The Nelson M Group LLC, and their members, managers, officers, employees, and agents, will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, or goodwill, arising from or related to your use of (or inability to use) the services, or from any insurance decision you make or do not make. Our total liability for any claim relating to the services will not exceed one hundred U.S. dollars ($100).

In jurisdictions that do not allow certain limitations, those limitations may not apply to you. These Terms never limit liability that the law says cannot be limited.

12Indemnification

If your violation of these Terms, your misuse of the Services, or your submission of a phone number or other information you were not authorized to provide leads to claims, damages, or expenses (like appropriate attorneys' fees), you agree to indemnify and hold harmless The Nelson M Group LLC and its affiliates and personnel.

13Disputes, governing law, and arbitration

Informal resolution first. Before filing a claim, please get in touch at [email protected] and give us 30 days to try to resolve it.

Binding arbitration. Excluding small-claims matters and claims for injunctive relief for intellectual-property misuse, any dispute between you and Gaskivo or The Nelson M Group LLC about these Terms or the Services is to be resolved by final and binding individual arbitration under the American Arbitration Association's Consumer Arbitration Rules. You may elect to hold it in your county of residence or by video or phone. The arbitrator may grant individual relief equal to what a court could, and judgment may be entered in any court of competent jurisdiction.

Class-action waiver. As permitted by law, each of us, you and Gaskivo, will bring claims only on an individual basis, and not as a plaintiff or class member in any class, collective, or representative proceeding.

Opt-out. Within 30 days of first accepting these Terms, you may decline arbitration by emailing [email protected] with "Arbitration Opt-Out" as the subject, and tell us your name and mobile number.

Governing law. The Federal Arbitration Act and the law of the state in which The Nelson M Group LLC has its principal place of business apply to these Terms, regardless of conflict-of-law rules. Where the arbitration clause does not apply, the state and federal courts in that state have exclusive jurisdiction.

14Termination

You may stop using the Services at any time, and may opt out of messages by replying STOP. We may suspend or terminate access at our discretion, including for violations of these Terms. Sections that by their nature should survive (including disclaimers, limitation of liability, indemnification, and disputes) will survive termination.

15Changes

We reserve the right to revise these Terms. Revised Terms will carry a new "Last updated" date, and your continued use of the Services after the effective date counts as acceptance. We will give notice of material changes as the law requires.

16General

Together with the Privacy Policy and SMS Terms, these Terms are our entire agreement with you on this subject. If a part is held unenforceable, the remainder stays in effect. Not enforcing a provision does not waive it. You cannot assign these Terms without our consent, but we may assign them as part of a merger or sale of the business.
